Epica decisone del Consiglio di Stato sul divieto di discriminazione nell’accesso al lavoro.
Il Consiglio di Stato, recependo le argomentazioni difensive contenute nel Ricorso al Presidente della Repubblica patrocinato dall’Avv. Maria Immacolata Amoroso, in rappresentanza di alcune appartenenti alla Polizia Penitenziaria, ha adottato il parere n. 1449/2023 e rimesso alla Corte Costituzionale la questione di illegittimità costituzionale delle norme vigenti che operano una vera e propria distinzione di genere nel ruolo degli ispettori del Corpo di Polizia Penitenziaria, postulando l’assunzione nel ruolo di un numero di uomini di gran lunga superiore a quello riservato alle donne, a prescindere dall’impiego in concreto del Personale poi reclutato.
È un ulteriore e concreto passo in avanti verso l’effettiva parità di genere e la garanzia di pari opportunità tra uomo e donna.
La Costituzione, con norma di straordinaria modernità (art. 51) stabilisce che “Tutti i cittadini dell’uno o dell’altro sesso possono accedere agli uffici pubblici e alle cariche elettive in condizioni di eguaglianza”.
Ma ciò non è sufficiente a realizzare l’agognata piena parità, considerato che la stessa norma rimanda alla legge il compito di regolamentare i requisiti per accedere agli impieghi pubblici, con la conseguenza che troppo spesso il legislatore ha finito per svuotare tale principio.
Ora la parola passa alla Corte costituzionale, ancora una volta chiamata a raddrizzare le storture della legislazione italiana.
Il cammino verso una piena parità di genere è ancora lungo, e passa attraverso una rivoluzione culturale che, sebbene in atto, non è conclusa.
Ma questo parere reca un insegnamento generale che, al di là della decisione che la Corte riterrà di prendere sulla specifica questione, non passerà, operando come vero spartiacque che in questa storia di donne e uomini consente di individuare un prima e un dopo.
