Siccome al centro (Largo L. Daga n. 2) pensano di non avere granché da fare e che tutto vada bene, trovano modo di perdere tempo su cose inutili e persino sbagliate.
Infatti nella Circolare predisposta dalla “competente” Direzione Generale dei detenuti il Capo del Dipartimento ha trascurato:
– che l’art. 38 del dpr 230 /2000 al n. 5 prescrive l’apertura delle buste e quindi il rischio che vuole salvaguardare lo si corre lo stesso;
– che l’art. 48 del dpr 82/99 prescrive nel regolamento di servizio il predetto controllo nelle buste;
– che nel momento in cui il detenuto o il difensore scelgono tale canale rinunciano alle “guarentigie” così come un detenuto che fa un telegramma;
– che la Costituzione tutela la segretezza di tutta la corrispondenza.
Ma soprattutto dal 2016 le PPAA dovevano dismettere i fax.
Viene da chiedersi: l ‘estensore della circolare e il firmatario sulla base di quali regole agiscono?
In sintesi, nella volontà del DAP(Dipartimento Amministrazione Penitenziaria), l’immagine del cetriolo e dell’ortolano è sempre tenuta ben presente e viva.
